DentalGoodNews|June 18, 2026 - Wyssta Services, Inc. ("Wyssta Services") has agreed to pay up to approximately $12.67 million (approximately RMB 86.04 million) to settle a class action lawsuit concerning the unauthorized use of tracking technology on its Delta Dental plan member portal. The lawsuit, titled "Feeler v. Wyssta Services, Inc.," alleges that Wyssta Services installed and operated advertising and analytics tracking technologies, including pixels and cookies, on the aforementioned online healthcare portal. The plaintiffs claim that this conduct, conducted without users' knowledge or consent, violated the U.S. Electronic Communications Privacy Act (ECPA) and the Illinois Eavesdropping Act. Under the settlement agreement, Wyssta Services will establish a fund totaling $12,670,284 to cover compensation for eligible class members, attorneys' fees, and administrative costs. Members who held accounts on the portal between January 23, 2021, and January 23, 2025, are eligible for a cash payment of up to $16.50 each. The final approval hearing is scheduled for September 9, 2026. According to available information, the website in question is an online healthcare portal for Delta Dental plan members operated by Wyssta Services, providing account access and service support to relevant users. Despite reaching the settlement, Wyssta Services denied all allegations in the announcement and maintained that it had not engaged in any wrongful conduct, stating that the settlement was reached to avoid the high costs and uncertainties of continued litigation. This marks another significant compliance challenge for Delta Dental in recent times. According to a previous report by DENTALGOODNEWS (Leading Dental Industry Media, DGN), on April 30, 2026, Delta Dental was fined $2.25 million by regulators for the MOVEit Data Breach incident and related failure to disclose. Additionally, the company currently faces antitrust class action lawsuits filed by dentists from four states, including California and Wisconsin.
