Actor Huang Denounces Dentist for Taking Photos Without Consent; Leaking Patient Privacy May Result in Fines of 10,000–30,000 RMB or License RevocationIssuing time:2026-06-12 19:51
DentalGoodNews|June 7, 2026. A celebrity surnamed Huang reportedly posted on social media, angrily accusing "a certain dentist of filming and spreading photos related to their treatment without permission," sparking public concern over privacy protection in the dental industry. Article 1,226 of the "Civil Code" clearly stipulates that medical institutions and their medical personnel shall keep patients' privacy and personal information confidential; leaking patients' privacy and personal information, or disclosing their medical records without patient consent, shall bear tort liability.
The "Personal Information Protection Law" also imposes compliance requirements on personal information processing activities and stipulates corresponding legal responsibilities for illegal processing of personal information. Regarding the management responsibilities of medical institutions, if a leak occurs due to inadequate information security systems, they may face administrative regulatory measures or administrative penalties. The "Basic Healthcare and Health Promotion Law of the People's Republic of China" stipulates that if a medical institution's medical information security system and safeguard measures are inadequate, leading to medical information leaks, or if its medical quality management and medical technology management systems and safety measures are inadequate, it may be fined between 10,000 and 50,000 yuan; in severe cases, it may be ordered to suspend relevant practice activities, and legal liability shall be pursued against the directly responsible supervisors and other directly responsible personnel.
Additionally, as medical personnel obtain a large amount of private information from patients during diagnosis and treatment, both the "Physician Law" and the "Nurse Regulations" require them to protect patient privacy in accordance with the law. According to a previous report by DENTALGOODNEWS (Leading Dental Industry Media, DGN), the National Health Commission and two other departments issued a notice in June 2025 on "Further Strengthening the Management of Electronic Medical Record Information Use in Medical Institutions," clarifying that medical institutions bear the primary responsibility for Electronic Medical Record|EMR information management, prohibiting operators from illegally disseminating patient medical record information through online channels, and requiring information protection to be included in performance evaluations.
